It is important to re-engage public health professionals, after an absence of almost a half a century, in the issues of land development and community design. It has been argued by Hull and others that a remnant of essentialism impeded taxonomic progress until systematists abandoned attempting to define taxa on the basis of characters necessary and sufficient for group membership. The advent of cladistics suggests instead that it is an essentialistic view of characters, not of taxa, that should be abandoned, and that only a transformational view of characters allows evolutionary novelties to be identified, much less explained. Conventional Darwinian explanations are not tautologous but are difficult (...) to test and scarcely explain evolutionary novelties, probably because of their emphasis on genetic rather than epigenetic (developmental) processes. The paper examines the legal, ethical, and public policy issues involved in the Union Carbide gas leak in India which caused the deaths of over 3000 people and injury to thousands of people. The paper begins with a historical perspective on the operating environment in Bhopal, the events surrounding the accident, then discusses an international situation audit examining internal strengths and weaknesses, and external opportunities and threats faced by Union Carbide at the time of the accident. There is a discussion (...) of management of the various interests involved in international public relations and ethical issues. A review of the financial ratio analysis of the company prior and subsequent to the accident follows, then an examination of the second tragedy of Bhopal — the tragic failure of the international legal system to adequately and timely compensate victims of the accident.The paper concludes with recommendations towards public policy, as well as a call for congressional action regarding international safety of U.S. based multinational operations. We consider the problem of pricing in a network industry focussing in particular on the issue of cross-network pricing (e.g. cross-network cell phone charges). Economic theory tells us in relation to cross-network pricing that collusion or network monopoly may yield welfare as well as profit benefits although any welfare benefits from cross-network collusion may be more than offset by a reduction in competition elsewhere. To address this, we introduce a new regulatory concept: the independent profit-maximising agent. The agent sets prices (...) on cross-network goods taking either (i) a complete, or (ii) an arbitrarily small, share of the associated profit. We examine welfare and profits with and without agent type (i) and (ii) with collusion (network monopoly) between the non-agent firms and without collusion (independent network duopoly). We show that splitting up the network monopoly (creating independent network duopoly) may be inferior for both society and firm(s) compared with a network monopoly ‘regulated’ by an agent and that society always prefers any of the four agent regimes over network monopoly and network duopoly. Indeed, employing the agent may reduce welfare losses by a large proportion while having relatively little effect on profit. (shrink)

This study examined the influence of 7 high school esports developmental programs on student self-regulation, growth mindset, positive youth development, perceived general health and physical activity, and sport behaviour. A total of 188 students originally participated, with 58 participants completing both pre- and post-program information. At baseline, no significant differences were found between youth e-athletes and their aged-matched controls. The analysis for the observation period showed a significant interaction effect for the PYD confidence scale, with post-hoc comparisons showing a significant (...) decrease in the control group from pre- to post assessment whereas the esports group remained the same. Time main effects showed a decrease in the self-regulation motivation factor, PYD connection factor and PA for all participants. Overall, this study showed that students enrolled in their respective school esports program did not differ from those who did not in self-regulation, growth mindset, PYD, perceived health and PA, and sport behaviour. It was likely that all participants showed a decrease in motivation, connection, and PA due to COVID19 lockdown during the study period. This study is the first to investigate the longitudinal impact of student involvement in high school esports and showed that esports participation did not have a negative impact on any health or psychological factors. In Holding Health Care Accountable , E. Haavi Morreim differentiates between duties of expertise and resource duties, arguing for tort liability respecting the former and contract liability respecting the latter. Though Morreim's book addresses ordinary clinical medicine, her liability scheme may also be relevant elsewhere. Focusing on disaster medicine, and especially the medical management of violent mass disasters (e.g., where terrorists have deployed weapons of mass destruction), I argue in this essay that Morreim's classification of duties still fits, but that (...) it is difficult to hold government powers accountable for their many resource and expertise duties. This difficulty is compounded by political arrangements that foist under-funded mandates for disaster services on healthcare providers. As a result of such arrangements, hospitals and clinicians are prone to liability for expenditures and clinical interventions that are beyond their scope. This problem can be mitigated, I argue, by examining and clarifying the apparent social compact between society and healthcare. (shrink)

Were terrorists ever to effectively deploy weapons of mass destruction, medical practice would be quickly transformed. Many ordinary clinicians would be asked or required to treat unfamiliar yet serious medical conditions in a setting of overwhelming urgency and impossible odds. Clinical focus would shift from doing good things for a succession of individual patients to considering many patients at once, a change that could beget loss of trust and rapport with patients. Clinicians might also experience restrictions in personal liberties and (...) appropriation of their property. The purpose of this essay is to develop a teleological framework for undertaking this transformation. In ordinary clinical medicine, the elusiveness of the individual telos (i.e., the good for the individual) is acknowledged in procedures (such as social history taking, informed consent and outpatient scheduling) designed to protect patients' (and clinicians') prerogatives to interpret the telos for themselves. In mass casualty scenarios, on the other hand, the telos is standardized and regarded as an Immediate Object (usually as a state of affairs in which survival is maximized and permanent disability is minimized). Clinicians who provide mass casualty care will face a number of ethical challenges that can be negotiated by appealing to the political and ethical rationale, and limits, pertaining to the pursuit of aggregate survival as an Immediate Object. Ne renonçant sur aucun point à l’universelle autorité du Sage éclairé par la Science, l’esprit cartésien couronne l’âge classique, inauguré par la science grecque, et dont le postulat fondamental est l’unicité de la valeur. L’esprit moderne est un repli vers la pluralité des valeurs.

J'examine plusieurs sources selon lesquelles Swyneshed (malgré les prétentions d'Angel D'Ors dans ses articles récents) donne une nova responsio en partie sous forme de la règle « On peut nier une proposition conjonctive après avoir concédé ses deux parties. » Je montre que cette nova responsio est liée à un rejet de la règle « Chaque proposition qui suit de l'ensemble de propositions déjà concédées doit être concédée », et j'attribue ce rejet à une théorie selon laquelle une inférence (...) se base sur le rapport logique entre seulement deux propositions. I examine a number of sources according to which Swyneshed (despite the claims made by Angel D'Ors in his recent articles) does give a nova responsio partly in the form of the rule « One can deny a conjunction whose conjuncts have already been granted. » I show that this nova responsio is linked to a rejection of the rule « Every proposition following from a set of propositions which have already been granted must be granted », and I attribute this rejection to a theory whereby an inference is based on the logical relations between just two propositions. Quand on parle d'une substance et de ses accidents, peut-on dire que tous deux sont des etants au meme sens? Quand on parle de Dieu et de ses creatures, peut-on dire que tous les deux sont bons ou justes au meme sens? Quand on parle d'une potion et d'un animal, peut-on dire que tous les deux sont sains au meme sens? Telles sont les problematiques metaphysiques, theologiques et semantiques que la notion d'analogie developpee par les penseurs du Moyen Age cherche (...) a affronter. Les quatre etudes, issues des Conferences Pierre Abelard presentees a l'Universite de Paris-IV Sorbonne en 2004, examinent les modes complexes selon lesquels ces trois problematiques se sont croisees et les questionnements nouveaux auxquels elles ont donne lieu pendant plus de quatre siecles. L'auteur interprete la pensee de Thomas d'Aquin dans le contexte qui en a permis l'emergence, et analyse les critiques qui ont suivi, ainsi que les reponses nouvelles qui ont ete avancees. Ce faisant, elle jette une lumiere nouvelle sur les rapports entre l'Aquinate et le Cardinal Cajetan, et sur l'importance de la semantique durant la periode medievale. (shrink)

Hans Jonas (1903-1993), philosophe juif allemand, eleve de Husserl, Heidegger et Bultmann, ami de Hannah Arendt, successivement etabli en Palestine, au Canada et a New-York, a elabore une pensee originale, trop souvent recue dans la dispersion. On le connait tantot pour ses travaux sur la Gnose, tantot pour son livre Le Concept de Dieu apres Auschwitz, ou encore sa biologie philosophique, ou enfin le principe responsabilite qu'il a formule. On se propose ici d'exposer les grands themes de cette oeuvre - (...) le nihilisme gnostique, l'enracinement dans le monde materiel, la refondation ethique - en prenant le concept de vie pour fil directeur parce qu'il donne a cette oeuvre plurielle son foyer et son unite. C'est en effet la decouverte d'un air de famille entre l'esprit de la Gnose et la pensee heideggerienne de l'existence qui conduit Hans Jonas a prendre conscience de l'oubli de la vie par la philosophie et a en repenser le concept dans un dialogue avec les donnees de la biologie. Fort d'une philosophie de la vie ainsi concue, il peut alors prendre en charge les defis contemporains lances par la technique en proposant une ethique de la responsabilite, qui fixe des obligations a l'egard de la vie et des generations futures. L'A. s'oppose à l'interprétation qu'en donne L. Gill dans son livre «Aristotle on Substance: The Paradox of Unity», selon laquelle l'ει~δο et la composition sont toutes deux premières. Les droits de l'homme sont un ensemble normatif qui donne à tout être humain des droits universels et inaliénables, malgré les différences religieuse, raciale, ethnique ou nationale. La dialectique hégélienne, en tant que négation de la négation, est souvent interprétée comme irrémédiablement téléologique, comme une froide mécanique qui rejette hors du sens toute contingence. Mérite-t-elle pour cela d'être abandonnée? Si la dialectique est bien ce qui meut tout donné, montrant qu'il ne peut résider en repos en lui-même, abandonner la dialectique revient à se résigner à la factualité et à renoncer à la promesse d'émancipation, de dépassement de ce monde donné, dont la pensée hégélienne est porteuse. Il (...) faudrait alors penser la dialectique sans la téléologie. Mais l'effort de Hegel n'est-il pas déjà de libérer autant qu'il est possible la dialectique de toute téléologie? De fait, si l'on se tourne vers deux auteurs qui ont critiqué et profondément réformé la dialectique hégélienne - Giovanni Gentile et Theodor Adorno - on se rend compte à l'examen de leur tentative que leur volonté de sauver la totalité de la contingence et leur refus conjoint de toute perspective téléologique conduit la dialectique à, en quelque sorte, s'écrouler sur elle-même. Ces deux formes " d'auto-destruction " de la dialectique montrent ainsi par l'absurde que la téléologie minimale conservée par Hegel n'a pour fonction que de préserver la dialectique. On peut alors interpréter la dialectique plutôt comme principe de détermination que comme moteur d'une téléologie prise en son sens plein ; c'est peut-être ce que nous le suggère la référence à Aristote par laquelle Hegel choisit de clore son Encyclopédie des Sciences philosophiques. In lieu of an abstract, here is a brief excerpt of the content:Philosophy and Literature 25.2 (2001) 364-367 [Access article in PDF] Book Review Hamlet in Purgatory Hamlet in Purgatory, by Stephen Greenblatt; xii & 322 pp. Princeton: Princeton University Press, 2001, $29.95. Hamlet in Purgatory is both more and less than literary criticism of Shakespeare's most haunting and most critically belabored play. Greenblatt has captured an evolving culture of belief which informs the play and goes far beyond source studies (...) or the history of ideas. He assays to show how the Medieval doctrine of Purgatory and the rejection of it by Protestant Reformers shaped the structure of Hamlet and the world of Hamlet's spiritual agony.Central to the argument is the notion that the rejection of Purgatory, and ritual practices associated with the doctrine, threatened to disrupt community and sever the relations between the living and the dead. Thus, the senior Hamlet's plea to "Remember me" takes precedence over his injunction to revenge; traditional preoccupations of Hamlet criticism become secondary to the concern for spiritual community which Reformation doctrine threatened. The exegesis is scholarly and the prose is engaging, yet the book suffers from the new historicist tendency to become absorbed more with context than with criticism and to assume too readily the relevance of the context to the criticism. Put another way, Greenblatt, like other new historicists, is not always rigorous in his inferences.Greenblatt warns that his book "requires a certain hermeneutical patience, a willingness to suspend direct literary analysis, in order to examine more thoroughly what has been treated as mere background for the canonical work of art" (p. 5). Although the book culminates in a description of the migration of discarded religious ritual into the theater, and a thoughtful commentary on Hamlet, Greenblatt cautions that "... for the book to work properly, the reader should understand literary analysis, and specifically the analysis of Hamlet, to be suspended in another sense as well, that is, distributed in tiny, almost invisible particles throughout my account" (p. 5). Amen. The caveats are essential for anyone who might expect an "interpretation" of Hamlet. Rather, Greenblatt has evoked the conflict of enduring beliefs and Reformist critiques which animated Shakespeare's imagination and Hamlet's suffering.Hermeneutical patience certainly is demanded of the reader, because more than half of the book presents commentaries on the doctrine of Purgatory from the late Middle Ages to the early seventeenth century. Greenblatt begins with Simon Fish's 1529 "Supplication for the Beggars," (p. 15) an anti-purgatorial (and anti-clerical) tract addressed to Henry VIII. Fish argued that the doctrine of Purgatory is at the heart of ecclesiastical corruption and is a danger to the state, because the fear that the doctrine can generate enables the clergy to extort enormous wealth in the form of "suffrages," donations for trentals, anniversary Masses, and other perpetual penitential memorials on behalf of the dead. Fish's argument is double: its theological burden is that Purgatory is a non-scriptural superstition; its rhetoric is that it is an abuse of the [End Page 364] poor and a danger to the economic solvency of the kingdom. Fish invokes both doctrinal error and political danger; this is thus an excellent tract to begin the elucidation of the complexity of Reformist objections to Purgatory in sixteenth-century England. Greenblatt adds that other Reformers saw Purgatory as a poetic creation, a fable, and therefore a vain imagining. John Donne's "Devotions upon Emergent Occasions" is cited to show that post-Catholic divines believed that purgation must be completed in this life.According to Greenblatt, an unintended consequence for the laity of the rejection of Purgatory is the creation of a radical divide between the living and the dead. If we pray for the dead, they are not as absent from us as if they had passed on to the timeless worlds of Heaven or Hell. Even if Purgatory is expensive or fabulous, its loss destroys a community with the dead that involved a reciprocal and continuing relationship, whereby the living can aid the dead towards Heaven and saved souls can eventually become intercessors in Heaven for the living... The question of the role of women in the Church, in other words, of women’s ministries, is still conditioned today, especially in the Catholic Church, by theological a priori and by anachronism. This essay aims to discuss and to point out the difficulties arising from both of these factors.

The true sacramental bond concerns the theological understanding of ordained ministry. Vincenzo Maggi, con un trattato –come lui stesso dichiara– breve e semplice, confuta il disprezzo verso il genere femminile imperante nella sua epoca, spinto dalla necessità di ritrovare la verità. Il tutto senza screditare né le tesi avverse (...) né i maschi; anzi, con l’intenzione di convincere costoro ad apprezzare ancor di più le donne e riconoscerne i superiori meriti. L’autore anonimo, invece, pretende smentire le affermazioni del filosofo lombardo esortando gli uomini all’azione, e si dichiara intimorito dall’idea che le donne possano prendere il sopravvento.
